Terms of Service

Please read these Terms of Service ("Terms") carefully before using UsabiliTree ("Service") operated by UsabiliTree ("we", "us", or "our").
1. Acceptance of Terms
By accessing or using UsabiliTree, you agree to be bound by these Terms. If you disagree with any part, you may not use the Service.
2. Description of Service
UsabiliTree is a web-based usability research tool for creating and conducting tree tests. The Service allows you to:
- Create tree test studies
- Share studies with participants
- Analyse results and export data
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must:
- Provide accurate information when registering
- Notify us immediately of any unauthorised use at support@usabilitree.com
- Not share your account with others
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on any third-party intellectual property rights
- Upload or transmit malware, spam, or harmful content
- Conduct studies that deceive, harm, or exploit participants
- Impersonate any person or entity
- Collect participant data without appropriate consent and disclosure
We are proud of what UsabiliTree is used for and expect the same from our users.
5. Study Limit and Payments
Free tier: Each account includes 3 studies at no charge.
Additional studies: You may purchase additional study packs (5 studies per pack) for a one-time fee of $5 USD per pack. Packs are stackable — there is no subscription or recurring charge. Purchased study packs do not expire and remain on your account indefinitely.
Payments are processed by Creem (creem.io), our Merchant of Record. By making a purchase you also agree to Creem's Terms of Service.
Refunds: All sales are final. Since study packs are digital goods that are immediately applied to your account, we do not offer refunds except where required by law. For refund disputes, please contact support@usabilitree.com.
6. Intellectual Property
You retain ownership of all content you create within the Service (studies, tasks, etc.). By using the Service, you grant us a limited licence to store and display your content solely to provide the Service.
The UsabiliTree platform, branding, and code are owned by us. You may not copy, modify, or distribute them without written permission.
7. Participant Data and Privacy
When you share a study link with participants, you are responsible for obtaining appropriate consent and clearly disclosing how their data will be used. You must comply with all applicable privacy laws (GDPR, CCPA, etc.).
We act as a data processor for participant data collected through your studies. Please review our Privacy Policy for full details.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, UsabiliTree shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to loss of data or revenue.
10. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time from the Settings page. Upon termination, your data will be permanently deleted.
11. Changes to Terms
We may update these Terms at any time. We will notify you by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law provisions.
